SEX WORKER'S PROBLEMS, RIGHTS, PROTECTION & PREVENTION
The recent Supreme Court Direction on sex workers has generated mixed reactions among women and some sex workers celebrate the verdict that asks police to treat sex workers with dignity, some social workers fear that it might not bring about a sea change in the fate of sex workers in this profession. Many days before NHRC asked the authorities to recognise sex work as informal work and register them so that they can get workers' benefits. Migrant sex workers should be included in schemes and benefits for migrant workers. so, what are the other problems sex workers are facing & how are sex workers defined in Indian law books? Should be known
WHO ARE SEX WORKERS & STATUS OF PROSTITUTION IN INDIA?
A sex worker is a gender-neutral definition which not only associated with women but another gender who are associated with the providing sex work either on a regular or occasional basis the term is used for those who work in all areas of the sex industry officially it is estimated that there are over 800000 sex workers in India however unofficial figures place these numbers far higher.
STATUS OF PROSTITUTION IN INDIA
According to the Indian penal code Prostitution in its broader sense is not illegal per se but there are certain activities which constitute a major part of prostitution that are punishable under certain provisions of the act which are 1) Soliciting prostitution services in public places 2) Carrying out prostitution activities in hotels 3) indulging in prostitution by arranging for sex workers 4) arrangement of a sexual act with a customer not only it but The immoral traffic prevention act 1986 is an amendment of the original act as per this act prostitutes are to be arrested if they are found soliciting their services or seducing others furthermore call girls are prohibited from making their phone numbers in public they can be punished for up to 6 months along with penalties if found doing so this kind reasonable& balanced limitation is on the prostitution at the same time upholding the persons right to earn their livelihood by doing it voluntarily.
SIGNIFICANCE OF DIRECTION AND OTHER PROBLEMS FACED BY SEX WORKERS
The court directions are Sex workers are entitled to equal protection of the law. Criminal law must apply equally in all cases, based on 'age' and 'consent'. When it is clear that the sex worker is an adult and is participating with consent, the police must refrain from interfering or taking any criminal action," If Government Accepts Courts direction 1) Sex workers will be afforded equal legal protection 2) if a worker reports a criminal or other types of offence the police will take it seriously and act by the law 3)If a brothel is raided the sex workers involved will not be arrested penalised harassed or victimised 4)Any sex worker who is a victim of sexual assault will be given all of the same services as a survivor of sexual assault including immediate medical attention 5)Police will be required to treat all sex workers with dignity and not verbally or physically abuse them subject them to violence or coerce them into any sexual activity .6)End of middle man this are the significance of court direction to the kind problems raised by created stereotype in society but there are other problems should be look into there are
1)sex workers are subjected to dignity and have the right to ensure citizenry rights like other citizens of India like issuing voter and ration cards for sex workers by state and central govt if govt giving certain kind of benefits they are not aware of it due to lake of knowledge.
2)Lack of knowledge they are unaware of sexually transmissible diseases they are facing many health issues like HIV etc…
HOW THIS PROBLEM CAN BE SOLVED & SEX WORKERS VAN BE PROTECTED?
India should learn from Germany where it legalised prostitution and the sex workers ae re provided with health insurance have to pay taxes and even receives social benefits like pensions so following the German method will ensure social benefits are guaranteed for all sex workers.
India should follow Greece, Canada, and Thailand these countries follow strict health regulations like providing health certificates before intercourse is mandatory so by following this India can prevent the transmission of sexual diseases.
But there is a major problem to be concerned that is trafficking which is prohibited by the constitution under article 23 if prostitution is legalised it can be in favour of pimps and they start running brothel houses which are going on in India, through India is a ratified nation to prevent suppress and punish trafficking in persons especially women & child India should draft new kind of methodology and laws to prevent trafficking with in the country and outside the country.
These are the rights & problems of the sex workers a job with no medical insurance no fixed timings no right to deny a customer no provident fund no access to government welfare schemes minimal vacation unhygienic workspace and customers who already are physically, verbally, and mentally abusive so there is a liability on governments to protect them but society should think on its persistence and there is a big responsibility on governments to prevent prostitution from society because human dignity & enlightenment should prevail over the emotions.
