RIGHTS OF DEITIES
Fundamental Rights are Fundamental to the life of People they can amplify personal intellectuality and spiritual well being but our narrow-mindedness made fundamental rights subjective to human beings its actual idea is objective to any living creature in the political territory of India but there are many main things to include to make this definition applies to those things one among them was deities A deity is typically conceptualized as a supernatural or divine concept, manifesting in ideas and knowledge, in a form that combines excellence in some or all aspects, wrestling with weakness and questions in other aspects, heroic in outlook and actions, yet tied up with emotions and desires. it is a belief of people of a particular religion to believe that deity is a living being and he/she holds a certain kind of sanctity, the ritual process that should be followed is considered to be the right of deities, however, not every deity is a legal person. This status is given to an idol only after its public consecration, or prana pratishtha. In Yogendra Nath Naskar vs Commissioner of Income-Tax (1969), the Supreme Court ruled: “It is not all idols that will qualify for being ‘juristic person’ but only when it is consecrated and installed at a public place for the public at large.” but in practice rights are deities are very limited there is Own property, Pay taxes, Sue and being sued, Do not have fundamental rights or other constitutional rights (Sabarimala case) Ignored one of the major things like Sanctity of the idol, ritualistic procedure, Financial rights so all organs of government should consider this rights of deities.
IMPORTANCE OF DEITIES RIGHTS
In many states in India government will control temples so this became a way for them to fund their manifestoed poll goals so ultimately temples are running out of money and they can’t able to finance their businesses which means sanctity & ritual process recently AP high court has exempted certain income gaining temples from endowment board but the order is not been implemented till now this is only some cases but there are many other ways where temples are exploited so it is very important to protect sanctity, ritualistic process, finances of deities Sanctity & Ritualistic process, financial rights of deities are associated with dharma so it is very important to protect the rights from westernised notion religious faith, beliefs which makes different morals of the coloniser to calculate indigenous ethics. some people may question that if the Deity is made from material elements, such as stone, marble, metal, wood, or paint, how can it be the spiritual form of God? The answer is given that since God is the source of all material and spiritual energies, material elements are also a form of God. Therefore, God can manifest as the Deity in the temple, though made of stone or other elements, since He/she can transform what is spiritual into material energy, and material energy back into spiritual energy. Thus, the Deity can easily be accepted as the Supreme since He/she can appear in any element as He/she chooses. In this way, even though we may be unqualified to see God, who is beyond the perceptibility of our material senses, the living beings in this material creation are allowed to see and approach the Supreme through His Archa-vigraha form as the worshippable Deity in the temple. This is considered His causeless mercy on the materially conditioned living beings. But this has been ignored in many cases by secular organisms.
Why it has been ignored?
Starting from Sabarimala to Gyan Vapi Shivalinga these kinds of rights are been ignored because When a Body or an organisation that is custodian to protect the way & sanctity of an institution is ignored and transferred its responsibility to the state then issues protecting the sanctity may get snatched and the interest of the state prevail above the interest of the institution the main interest of the state was upholding the constitutional ideals ie. Secularism which is a colonised thought process& imposition of colonial is not only in political nature but majorly in spiritual as well as economical nature so coloniality refers to a meta phenomenon that affects the mental constitution of the colonised society and reorients its entire worldview to bring it in line with the colonisers by distorting stereotyping eliminating or acculturating the indigenous world view example colonised view of religion is faith system but India religious concept of religion is not a faith system but knowledge seeking system which means a society of seekers which means there is no pressurised imposition of one way of life on the other to practice but accepting all kind of way of lives which means everyone has to right to exists so this kind of difference from one religion to other religion is not considered as a result of its rights of deities being ignored
The civilisational premise of India which means accepting ideas and allowing other ideas to be sustained is what India contributed to the world pool of knowledge that is an end product of following the Sanatana dharma so the prevailing secular interest of the state over the interest of dharma in religious matters should be corrected by removing colonial lens over the indic thought process example government of India thought majority of temples are run by the single community but in reality, it is not the picture because many temples are run by many other communities belonging to Hindus so there is no question of raising inequality if government rolled out of religious matters. So, the government should grant rights to deities to protect the sanctity of their place, ritual process and financial rights which are constitutionally mandated. in the short rolling back state from every religion makes dharmas interest will prevail over the state.
